The European Commission adopted its evaluation report on the Data Retention Directive this week. In anticipation of the Commission to hide the numerous failures of the Directive by omission and dissemblance, EDRi produced a "shadow report" providing a more accurate assessment of the Directive, using the Commission's own methodology. The Commission lived down to our expectations, with the report itself and the Commissioner's press conference producing an imaginative selection of misleading statements.

The Data Retention Directive was adopted in 2006 in very controversial circumstances. Article 15 of the Directive placed a clear obligation on the European Commission (EC), to submit "no later than 15 September 2010" a report on the evaluation of the Directive and its impact on economic operators and consumers". Today is the 203rd day since that evaluation report was due to be published.

The Czech Constitutional Court decided today, 31 March 2011, that the national implementation of the data retention directive is unconstitutional, in a complaint drafted by EDRi-member Iuridicum Remedium (IuRe).

A study of police statistics published by the German Federal Crime Agency on 26 January 2011, finds telecommunications data retention ineffective for the prosecution of serious crime.

An analysis of Federal Crime Agency statistics published on 27 January 2011 by German civil liberties NGO AK Vorrat reveals that data retention, while in force, did not make the prosecution of serious crime any more effective.

The Cyprus Supreme Court decided on 1 February 2011 that some of the provisions of Law 183 (I) / 2007 on disclosure of telecommunications data are unlawful, as they breach the Cyprus Constitution and its jurisprudence, as revealed by the daily Cyprus Mail.

Law 183 (I) / 2007 (Retention of Telecommunication Data for Purposes of Investigation of Serious Criminal Offences Law of 2007) was adopted by Cyrpus on 31 December 2007 as the national implementation of the EU Data retention directive.

Romanian NGOs demand stopping data retention in Europe

In an open letter sent to the European institutions, several Romanian NGOs, including EDRi-member APTI Romania, demanded stopping data retention in Europe, following the decisions of the Constitutional Courts in Romania and Germany.

The letter asks the European Commission to take advantage of the evaluation process of the Data Retention Directive in order to correct the mistakes of the past and to nullify the Directive, as it has been shown there are difficulties in obtaining the relevant data regarding the efficiency of such a system.

Three EDRi members,Netzwerk Neue Medien (Ralf Bendrath), Bits of Freedom (Axel Arnbak) and Panoptykon Foundation (Katarzyna Szymielewicz), together with one observer Patrick Breyer from AK Vorrat, gave a talk on data retention and hosted a workshop for activists during the Chaos Communication Congress (CCC) which is Europe's biggest meeting of the hacking communities and which takes place every year in Berlin. The 27th congress was held under the revealing title "We come in peace".
