Romanian Senate rejects the new data retention law

Following the pressure of the European Commission to the Romanian authorities to implement the data retention directive and despite the decision of the Constitutional Court from 2009 against the data retention law, a new draft law has emerged, but it was rejected by the Senate at the end of 2011.

The Romanian Ministry of Communications and Information Society (MCSI) has tried to have the new draft promoted as a Government proposal, but has failed to do so for unclear reasons.

The EDRi-member Quintessenz - Austria has published a leak of an internal paper from the Commission intended to inform DAPIX, the Council's working party on information exchange and data protection, of the results of the Commission's consultation in April 2011 on the reform of the Data Retention Directive (DRD). It raises a number of issues with the Directive that the Commission wishes to tackle in order to cast it in a better light.

Today, 14 December 2011, the Austrian Arbeitskreis Vorratsdaten (Working Group against Data Retention Austria - AKVorrat.at) handed over a petition to the Austrian Parliament, asking for the government to be obliged to engage against the Data Retention Directive at the EU level and to evaluate the whole set of existing anti-terror legislation.

In September 2011, European Digital Rights and 37 other NGOs sent a detailed letter to the European Commission with regard to the current stage of the review of the Data retention Directive - the impact assessment. The purpose of the letter was to provide early input to the Commission, in order to give maximum opportunity to take our concerns into account. The response from the Commission acknowledges the problems with the Directive.

On 26 September 2011, European Digital Rights and 37 other NGOs from 14 countries sent a letter to Commissioners Malmström, Kroes and Reding on the review of the Data Retention Directive. The purpose of the letter is to provide input into the Commission's ongoing work on a review of the legislation.

Earlier this year, EDRi published a "shadow" Implementation Report in order to address the shortcomings of the official Implementation Report from the European Commission.

Sweden argues that transposing data retention directive is unnecessary

On 5 September 2011, the Swedish government responded to the European Court of Justice after the Commission referred Sweden to the Court for failing to transpose the Directive on Data Retention (2006/24/EC).

Sweden's main argument is that it is unnecessary to transpose the Data Retention Directive, considering the practical effects of existing Swedish legislation.

Dutch Senate "disappointed" with Data Retention Directive evaluation

The same week the Dutch Senate approved a long-anticipated shortening of mandatory retention periods for internet data to six months, it published its correspondence with the Dutch Minister of Security and Justice on the Data Retention Directive evaluation by the European Commission.
