EU-US PNR agreement found incompatible with human rights

In a note sent on 16 May 2011 to the Director-General of DG Home Affairs, the Legal Service of the European Commission warns that the draft EU-US agreement on the exchange of PNR data is not compatible with fundamental rights.

The EC's lawyers found several areas of concern related to the planned agreement.

In late May 2011, the new draft agreements on the transfer and retention of air passenger data between the EU and the United States and Australia respectively have leaked to the public. The re-negotiation of the agreements from 2007, which have since then been provisionally applied, had become necessary after the European Parliament refused to vote on them in May 2010.

The new agreements do not substantially improve the situation with regards to the old ones.

Peter Hustinx, the European Data Protection Supervisor (EDPS) issued on 25 March 2011 his opinion on the European Commission's proposal to oblige airline carriers to provide EU Member States with personal data (PNR) on passengers entering or leaving the EU space, with the declared purpose to fight serious crime and terrorism.

On 2 February 2011, the European Commission made a new proposal for a PNR Directive, to extend the passenger-tracking systems already in use in the UK and US to all flights to and from the EU.

On 2 February 2011, the European Commission released its proposal for a directive on the use of Passenger Name Records. This would require airlines flying into and out of the EU to give travellers' personal information to national authorities in the Member State of departure or arrival.

As negotiations continue between EU and USA on the issue of air passenger data (PNR) transfer, so is the debate on the issue between the European Commission and the other EU bodies.

The European Parliament (EP) issued on 11 November 2010 a resolution on the matter.

It has recently been revealed that UK Police secretly investigated the PNR (Passenger Name Records) data of 47 000 innocent people having travelled in and out of UK in 2009.

Checks included scrutiny of the police national computer, financial records and analysis of "known associates" related to travellers including information on their family and friends before being cleared for travel.

The airline problems in Europe that have affected also many MEPs, have postponed a series of voting sessions scheduled for this week in Strasbourg, including the votes on PNR and SWIFT resolutions.

The US Administration declared that it hoped to continue "realistic" negotiations with the EU for a new bank data transfer deal with the EU, allowing American investigators to track terrorism funding.

The European Parliament (EP) has discussed last week the PNR (Passenger Name Records) agreements with the US and Australia.

MEP Sophie In't Veld (ALDE, Netherlands) explained that the Parliament has traditionally been more opposed to PNR agreements than to SWIFT. She said that it would be inappropriate to give the Parliament an option only to say "yes" or "no" to the proposal.
