Belgium: Francophone press goes out and back in Google Search

As a result of Google's conflict with Copiepresse, the search engine announced on 15 July 2011 that it would not index titles from the Belgium francophone press.

Google stated that in doing so, it only complied with the decision of the Appeal Court of 5 May 2011 that backed a court decision of February 2011 forbidding Google to publish Belgium press articles on Google News and Google Search, with a fine reaching 25 000 euro in case of non-compliance.

Fair-Play Alliance (AFP), a Slovak non-governmental organization operating znasichdani.sk site, was required by a Bratislava District Court to take down from the website information related to certain public procurement contracts.

The website was created in March 2011 in order to provide "a tool that would enable journalists and watchdogs to cross-check information about companies successful in public procurements with influential persons in these companies".

On 12 July 2011, the European Court of Justice ruled on the liability of online marketplaces for trademark infringements by users and the scope of the hosting safe harbour of the E-Commerce Directive. The case results from legal proceedings between L'Oréal and eBay in the UK. The ECJ concluded that the safe harbour for hosting providers only applies to third party data processing that is merely technical and automated, as well as passive and neutral.

A working group at the Danish Ministry of Justice is debating on a recommendation to the Parliament. The current text suggests that people using open wireless internet connections, e.g. at libraries, cafes, and private companies identify themselves with a personal code.

On 23 May 2011, there was an event in the International Press Centre in Brussels, hosted by ECIPE. Participants in the event were Erika Mann (Executive Vice President, CCIA; Board Member, ICANN), William Echikson (Head of Free Expression, EMEA, Google), Marietje Schaake (Member of the European Parliament, the Netherlands), Hosuk Lee-Makiyama (Director, ECIPE), Uri Rosenthal (Dutch Minister for Foreign Affairs) and Carl Bildt (Swedish Minister for Foreign Affairs).

Erika Mann said that the politics and governments were dividing the Internet.

UN report examines online censorship

The right to seek, receive and impart information, and the right to express oneself freely - rights which enable the exercise of a range of other human rights - are increasingly being limited by impediments in online communications, according to a report by the United Nations Special Rapporteur on the promotion and protection of the right to freedom of opinion and expression, Frank La Rue.

EDRi took part in an expert group that supported the Special Rapportur's preparation of the report, which looks at prevailing tendencies in global online freedoms.

Dutch ISPs admit to using deep packet inspection

During an investors day on 10 May 2011 in London, Dutch Internet service provider KPN admitted to using deep packet inspection (DPI) technology, to determine the use of certain applications by its mobile internet customers. Vodafone soon followed with an announcement that it used this technology for traffic shaping.

EU and China adopt harmonised approach to censorship

The European Union and China appear to have agreed to share their preferred approaches to censorship, producing a model that is a perfect mix between current EU and Chinese policies.

On 20 April 2011, at an event in the European Parliament entitled "Creative Industries: Innovation for Growth", the French European Commissioner for the Internal Market, Michel Barnier, announced plans to make focus on Internet providers to enforce intellectual property.
