EDRi position on data protection

EDRi submitted a response to the consultation on the legal framework for the fundamental right to protection of personal data. The response, which was sent on 23 December, sets out the challenges to the existing data protection framework and offers recommendations to address these challenges.

Among the challenges identified are the increasing amount of personal data being collected and processed, advanced profiling technologies becoming available and the shortcomings in terms of enforcement and independent oversight of the existing legal framework.

EDRi recommends that the following measures are taken:
- stronger principles ensuring data minimisation should be introduced;
- the interpretation of the term "personal data" should be clarified;
- administrative oversight and enforcement should be strengthened;
- civil enforcement should be strengthened.
